Office
of the Town Manager
This
office shall be headed by a Town Manager, who shall be
appointed by the Town Commission on the basis of their
executive and administrative qualifications. The Town Manager
shall be the Chief Administrative Officer of the Town, and
shall be directly responsible to the Commission for all Town
affairs placed in their charge by the Charter or by ordinance
or resolution. The Town Manager when necessary shall appoint,
suspend, demote or dismiss any Town employee under their
jurisdiction in accordance with the law and the personnel
rules, and may authorize any Department Head to exercise these
powers with the respect to subordinates in that department. The
Town Manager shall direct and supervise the administration of
all departments of the Town except the Offices of Town Clerk
and Town Attorney, and shall attend all Commission meetings
unless excused by the Commission, and shall have the right to
take part in discussions, but not vote. The Town Manager shall
see that all laws, Charter provisions, ordinances, resolutions,
and other acts of the Commission subject to enforcement are
faithfully executed. The Town Manager shall also prepare and
submit the annual budget, budget message, and capital program
to the commission, and shall keep the Commission fully advised
as to the financial condition and future needs of the Town, and
shall be responsible for adhering to the approved budget. The
Town Manager shall make such recommendations to the Commission
concerning the affairs of the Town as deemed advisable. The
Town Manager shall endorse all instruments in writing in which
the Town is interested, sign Town checks as authorized by the
Town Commission, and execute contracts on behalf of the Town,
unless the Commission shall otherwise provide. The Town Manager
shall by letter designate an Acting Town Manager to exercise
their powers and perform their duties during temporary absences
or disability of the Town Manager. The Commission may revoke
such designation at any time and appoint another eligible
person to serve as Acting Town Manager. Click here to view

Office
of the Town Clerk
This
office shall be headed by a Town Clerk appointed by the
Commission to serve the Commission. The salary of the Town
Clerk shall be fixed by the Commission. The Town Clerk shall be
under the administrative direction and control of the Mayor.
The Clerk shall be: Clerk of the Commission and shall keep the
Commission journal; custodian of ordinances, resolutions, and
such other official records as the Commission may prescribe;
attester to contracts, bonds and other instruments as may be
prescribed by law; chief registration and elections officer of
the Town; and responsible for other duties so prescribed by the

Office
of the Town Attorney
This
office shall be held by an attorney, appointed by the
Commission. The salary of the Town Attorney shall be fixed by
the Commission. The Town Attorney shall be legal advisor and
attorney to the officers of the Town in matters affecting the
Town or relating to their official duties; prosecute and defend
in behalf of the Town all civil actions in which the Town is a
party; prepare and endorse written instruments in which the
Town is concerned; be prosecutor in the Town court; and perform
other duties as the Commission may require or as may be
prescribed by general state law, consistent with this Charter
and with ordinances or resolutions of the Commission. One or
more assistants may perform any duties of the Town Attorney.
The Town Attorney and his assistants shall be lawyers admitted
to and having authority to practice in all courts of the state,
as well as the Federal District Court. Our Town Attorney is
Paul Gougelman.
Building
Official
The
official designated by the Town Manager and charged with the
administration, interpretation, and enforcement of concurrency,
building, flood control, coastal construction, coastal setback
regulation, landscaping and trees, and environmentally sensitive
lands, all as set forth in the Land Development Code. The
Building Official also serves as the Code Enforcement Officer
for the Town of Melbourne Beach.

Zoning
Official
The
Zoning Official is designated by the Town Manger and charged
with the administration, interpretation, and enforcement of
general code administration, comprehensive planning,
subdivision regulation, zoning regulation, takings, vested
rights, and due process, all as set forth in the Land
Development Code.

Fire
Department
The
Melbourne Beach Volunteer Fire Department was founded in 1953
as the first organized fire department for the south beaches.
Today, the all volunteer department has two Class A pumpers,
one mini pumper, two support vehicles and an inflatable boat
for marine rescue. The members of the Department come from all
walks of life and from all age groups. Trainings are conducted
on a weekly basis in order to maintain a high standard of
readiness. There is also a cadet program for students between
the ages of fifteen and eighteen. The Department is engaged in
Fire Prevention programs at the local schools and day care
centers throughout the year and during Fire Prevention Week in
October. The Annual Children's Christmas parade, established in
1966 is one of the community events sponsored by the
Department. The Department started the first Brevard County
Annual Volunteer Firefighter's Competition in 1991. The
Department is continually recruiting men and women in the
community of Melbourne Beach to serve as volunteer
firefighters. Anyone interested in volunteering is encouraged

Police
Department
The
Melbourne Beach Police Department was created in 1947. In the
beginning there was just one Police Officer, Chief Orval
Gardenour serving a population of 100 hearty souls. The Chief
answered calls for service 24 hours a day driving his 1938
Hudson. Apprehending turtle poachers and helping tourists dig
their cars out of the sand was all in a days work.
As
the demand for services increased the department expanded and
currently consists of a Chief, a Lieutenant, 2 Sergeants, 6
Officers and 1 Administrative Assistant. Melbourne Beach Police
Department is a full service law enforcement agency providing
service 24/7.

Department is connected to the "9-1-1" emergency
system and calls are dispatched through a regional dispatch

Public
Works
The
Public Works Department provides a variety of service to the
residents of Melbourne Beach. The Department provides three
specific types of services: vehicle and equipment maintenance;
building maintenance; road and sign maintenance, and parks and
grounds maintenance. The Department repairs and performs
preventive maintenance and modifications to all Town
structures, cleans and repairs all storm drain inlets; cleans
storm drainage ditches; maintains 16 miles of Town street and
replaces damaged signs and installs new signs as required. The
Public Works Department also maintains all of the Town parks
and implements most of the beautification projects.
