MINUTES TOWN COMMISSION SPECIAL MEETING December 13, 2000 A special meeting of the Town Commission of the Town of Melbourne Beach, Florida was called to order by Mayor Wille at 7:04 p.m. on Wednesday December 13, 2000 in the Community Center. Mayor Wille also led the Pledge of allegiance to the flag. Mayor Wille stated that the Town Commission held a workshop on November 29th and it was the consensus of the Town Commission not to renew the Town Manager's agreement and the Town Manager has offered a letter of conditional resignation. Mayor Wille asked to discuss agenda item II. prior to agenda item I. II. DISCUSSION OF TOWN MANAGER SELECTION PROCESS Mayor Wille stated that Commissioner Betten was to contact the former Cocoa City Manager, Terry Sewell regarding the Interim Town Manager position. Commissioner Betten advised that he did speak to Mr. Sewell and he advised that he recently accepted the position of Fire Chief for Lake County on a full time basis. Commissioner Betten stated that he did discuss the position with Mr. Sewell and he stated that he did have an interest in the position. The Town Commission reviewed the previous time line for the Town Manager selection process (attachment #1). Commissioner Smith stated that she is still willing to serve as Interim Town Manager. The Town Commission reviewed the previous Town Manager advertisement and asked the Town Clerk to update the annual budget amount, number of employees, population and change the salary range from $40-50 thousand to $50-60 thousand. COMMISSIONER STACEY MOVED, SECOND COMMISSIONER BETTEN TO APPROVE SUBMITTAL OF THE ADVERTISEMENT, WITH UPDATED ADJUSTMENTS, FOR TOWN MANAGER IN THE ICMA FLYER, FLORIDA LEAGUE OF CITIES DATAGRAM, FLORIDA LEAGUE OF CITIES QUALITY CITIES PUBLICATION AND FLORIDA CITY AND COUNTY MANAGER=S ASSOCIATION PUBLICATION, WITH A CUT OFF DATE TO BE EITHER THE END OF FEBRUARY OR MARCH, DEPENDING ON ADVERTISEMENT DATES. VOTE: ALL AYES. MOTION CARRIED. COMMISSIONER STACEY MOVED, SECOND COMMISSIONER BETTEN THAT MAYOR WILLE CONTACT MR. TERRY SEWELL AND THE DISTRICT RANGE RIDER OF THE INTERNATIONAL CITY MANAGER'S ASSOCIATION TO REQUEST APPLICATIONS OF AVAILABLE QUALIFIED CANDIDATES FOR THE INTERIM TOWN MANAGER POSITION. VOTE: ALL AYES. MOTION CARRIED. I. DISCUSSION AND POSSIBLE ACTION REGARDING ACCEPTANCE OF CONDITIONAL RESIGNATION OF TOWN MANAGER The Town Commission reviewed a letter of resignation submitted by Town Manager Ciummo, dated December 8, 2000. Mayor Wille noted that under item number 5., the hours of sick time pay due the Town Manager should be 111.25 hours rather than 137.95. Mayor Wille advised that he had a question regarding the hourly rates on the vacation and sick time, which is $29.09 because the severance pay is based on the base hourly rate, which is $26.44. Mayor Wille stated that after a discussion with the Town Manager, the vacation time and sick time rates include the ICMA retirement benefit. Mayor Wille stated that he believes this conditional letter of resignation is reasonable and that the Town Commission has had a consensus of a desire to change the management structure of the Town. Mayor Wille stated that he is most appreciative of the time, efforts and work the Town Manager has put forth. COMMISSIONER SMITH MOVED, SECOND COMMISSIONER STACEY TO ACCEPT THE TOWN MANAGER'S RESIGNATION EFFECTIVE AT 5:00 P.M., JANUARY 18, 2001 PER THE AGREEMENT DATED DECEMBER 8, 2000. TO INCLUDE THE CONDITIONS STATED THEREIN WITH THE FOLLOWING AMENDMENTS: NUMBER 2. THAT COMPENSATORY TIME ACCRUED, BE ALLOWED TO BE TAKEN, IF NECESSARY FOR JOB INTERVIEWS. THE MANAGER BE ALLOWED FUNERAL LEAVE PER CHAPTER 15, SECTION 15.01 OF THE TOWN'S POLICIES AND PROCEDURES MANUAL FOR IMMEDIATE FAMILY AS DEFINED IN SECTION 2 OF THAT MANUAL; NUMBER 5. THAT THE SICK LEAVE BE RECALCULATED AND CORRECTED; NUMBER 8, THAT THE DETAILED MEMO ON ALL PROJECTS BE PROVIDED TO THE SUCCESSOR, TOWN CLERK AND TOWN COMMISSION; AND, THAT THIS AGREEMENT BE SIGNED BY THE MAYOR. VOTE: ALL AYES. MOTION CARRIED. Mayor Wille asked the Town Manager that concise files of all projects be included with the memo and carried over in comprehensive files. Town Manager Ciummo stated that she owns a home in this Town and has a vested interest in having the Town progress forward. Commissioner Betten stated that the Town Manager has a file system in her head and feels that as a preparation for the future, everything that she can put down on paper will help smooth this process. Mayor Wille opened the meeting for comments from the citizens. Martha Russo, 420 Sunset Boulevard stated that she is disappointed that the Town Commission has accepted the Town Manager's resignation. Ms. Russo stated that she believes the Manager has been supportive of the Town volunteers and has brought grant projects to the boards. Ms. Russo stated that she is sorry to see her leave next month. Tony Strazzo, 407 Surf Road stated that he has been a resident for almost 19 years and thanked the Town Manager for what she has done for the Town. Mr. Strazzo stated that the past 3 years have been a calm period for the Town and that positive things have happened in this time. Mr. Strazzo stated that he is sorry to see the Town Manager leave and asked the Town Commission to reconsider accepting the Town Manager's resignation. Mayor Wille reported that the lift station project by the pier is on hold for the time being and the Town's consulting engineer is meeting with Dick Martins to determine what options might be available. Mayor Wille stated that they will bring those options back to the Town Commission. Commissioner Remark requested that the Town Commission not forget the Town Manager's offer to work on an hourly rate as Town Manager after her resignation date. Mayor Wille asked if there is any desire to reconsider the direction that the Town Commission has taken. There were no comments. Mayor Wille stated that he believes there needs to some recognition of the efforts put forth by the five members of the Town Commission who help shape a policy that has been stable, fair and reasonable in working with the Manager which helps with the stability and improvements in the community. III. ADJOURNMENT COMMISSIONER STACEY MOVED, SECOND COMMISSIONER BETTEN TO ADJOURN. VOTE: ALL AYES. MOTION CARRIED.
