A workshop of the Town Commission of the Town of the Town of Melbourne Beach, Florida
was called to order by Mayor Crispen at 7:03 p.m. on Thursday, August 7, 2003 in the Community
Center. Mayor Crispen also led the Pledge of Allegiance

I. DISCUSSION/REVIEW OF RESOLUTION NO. 702 AND AS AMENDED BY RESOLUTION NO. 708
Mayor Crispen opened the meeting and stated that Commissioner Walters had wanted this agenda item
and asked that he proceed. Commissioner Walters stated that he was dissatisfied with the incidents that
took place at the last meeting held on July 29th and he hoped the Town Commission could come to an
agreement to follow Resolution No. 702 and when there is a conflict, Roberts Rules of Order. Commissioner
Walters reviewed the events of the July 29th meeting noting how many times the Town Commission was
interrupted during the meeting, contrary to the rules.
The Town Commission discussed the events of the meeting and how they each felt about how the Commission
handled themselves and the public during the meeting. Members of the Town Commission were concerned that
they were interrupted during the meeting by either another member of the Commission, a member of the public,
or a member of the Town staff and discussed how to handle such situations in the future.
Town Attorney Gougelman and the Town Commission discussed parts of Roberts Rules of Order and Town
Attorney Gougelman commented that there is a meeting that can be run strictly by the rules or a meeting
that is a more laid back process where the rules are employed where needed. Town Attorney Gougelman
commented that the problem with most Boards that he has seen is where a body tries to live by the rules
and is so consumed in following proper process, they get nothing done. Town Attorney Gougelman commented
that he recommends a more relaxed approach in running meetings.
Town Attorney Gougelman stated that when a “Point of Order” is called at a meeting, that person is
recognized, the Chair makes a ruling on whether or not that “Point of Order” is properly taken or not
properly taken and what the basis for the ruling is; and, if someone wants to disagree, they have the
right at that point (and it has to relate to the rules of procedure because a “Point of Order” deals with
procedure), to appeal the Chair’s determination to the full body and it is up to the full body to vote
against the determination. Town Attorney Gougelman pointed out that when the “point” is not well
taken, the Chair should state the basis for the ruling.
Mayor Crispen called for a recess at 6:58 p.m. and called the workshop back to order at 7:07 p.m.
II. CONTINUED REVIEW OF PROPOSED FISCAL YEAR 2003/2004 MUNICIPALBUDGET
Town Manager Hoskovec recommended to the Town Commission that the Town expend the budget at
95% of ad valorem taxes, which will bring in an additional $42,473 in revenue over the previous version
of the budget presented on July 31, 2003.
The Town Manager and Town Commission began review of each budget category of the proposed Fiscal
Year 2003/2004 budget.
It was suggested to revise the budget to footnote the reasoning for the budgeted amount of $100,000 in fines
and forfeitures and expand the Town Manager’s budget message to address this line-item footnote. It was
noted that a new depreciation item has been included under miscellaneous income, and the Town Clerk
position has been moved from the Executive to the Legislative portion of the budget this year.
There was a lengthy discussion regarding justification of the Finance Clerk position and it was the consensus
of the majority of the Town Commission to retain the Finance Clerk position in the budget.
It was noted that there needs to be a footnote under the General Services budget as to why it shows zero
balances in each line item.
Chief Loizzo was present and reviewed the Law Enforcement budget with the Town Commission.
Fire Chief Hunter was present and reviewed the Fire Control budget and suggested that the saving fund to
be used toward the purchase of a new fire truck should be $100,000 rather than $80,000. After a discussion
about the purchase of a new fire truck, it is suggested that the fire department go out for three (3) bids for a
new fire truck and look into the annual funding amounts needed and bring these back at the next budget workshop.
Town Manager Hoskovec addressed the Town Commission regarding the salary survey results and recommended
that seven (7) positions be adjusted 3% to the step plan. After a presentation by Sergeant Siniscal and Officer
Dodson regarding salary plans for the police department employees, Town Manager Hoskovec requested that
the Chief of Police contact all police departments in Brevard County and request a copy of their step plans, to
include insurance plans, prior to the next budget workshop.
It is the consensus of the Town Commission that there be an additional workshop scheduled to review the
proposed budget on Wednesday, August 27, 2003 beginning at 6:00 p.m.
The workshop adjourned at 10:38 p.m.
